Terms of Service

You must provide accurate information, keep it current, and maintain the confidentiality of your password. You are responsible for activity under your account and must notify us promptly if you suspect unauthorized access.

You may not impersonate another person, create an account for someone else without permission, sell or transfer your account, or use automated methods to create accounts. Usernames may be reclaimed when reasonably necessary to address infringement, impersonation, inactivity, or community safety.

You retain ownership of content you submit. You represent that you have the rights needed to share it and that it does not violate these Terms or another person’s rights.

When you submit content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, publish, display, distribute, and otherwise use that content solely to operate, improve, promote, and protect the Service. This license ends when your content is deleted from our systems, except where it has been shared with others, retained in backups, or must be kept for legal, safety, or operational reasons.

You may provide ideas or feedback about the Service. We may use that feedback without restriction or compensation to you.

You are responsible for listings you publish and transactions you enter, including their legality, accuracy, pricing, condition, delivery, payment, taxes, permits, warranties, and compliance with consumer, housing, employment, and other applicable laws.

We do not verify every user, listing, item, or claim and do not guarantee identity, quality, safety, legality, availability, or completion of a transaction. Inspect items, protect personal information, use secure payment methods, and meet in a safe public place when appropriate. You assume the risks of interacting and transacting with other users.

We may remove listings, limit categories, or restrict marketplace access at any time. A listing marked “sold” or a transaction recorded in the Service is a convenience record and does not make us a party to the underlying exchange.

Austin Karma is a feature of the Service used to recognize participation and enable eligible in-Service activity. Unless we expressly state otherwise, Karma is not legal tender, money, a deposit, a security, or a stored-value account; it has no guaranteed cash value and is not redeemable for cash from atxatx.

We may establish or change rules for earning, using, transferring, expiring, limiting, or reversing Karma. We may correct balances and reverse transactions affected by error, fraud, abuse, removed votes or content, or violations of these Terms. You may not sell Karma, exchange it outside approved Service features, manipulate its distribution, or use it for unlawful activity.

Karma features may be modified, suspended, or discontinued. To the extent permitted by law, we are not responsible for any perceived loss in Karma value or availability.

We may review, restrict, remove, label, or preserve content; limit features; reverse Service activity; or suspend or terminate accounts when we reasonably believe it is necessary to enforce these Terms, community rules, or law, or to protect the Service or others. We are not obligated to monitor all content and cannot guarantee that objectionable content will be removed immediately.

If you see content or behavior that appears to violate these Terms, use the available reporting tools. Do not misuse reporting systems to harass others or suppress lawful participation.

The Service, including its software, design, branding, and content we provide, is owned by or licensed to atxatx and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Service.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as permitted by law or with our written permission. Third-party links and services are controlled by their providers, and we are not responsible for them.

You may stop using the Service or close your account at any time. We may suspend or terminate your access, or discontinue all or part of the Service, if you violate these Terms, create risk or legal exposure, or where reasonably necessary to protect the community or Service.

Provisions that by their nature should survive termination will survive, including those concerning ownership, content licenses already relied upon, disclaimers, limitations of liability, indemnification, and general terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, error-free, or accurate, or that content, users, listings, transactions, or outcomes will meet your expectations. Advice or information obtained through the Service does not create a warranty not expressly stated in these Terms. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATXATX AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US, IF ANY, DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where liability cannot legally be limited.

You agree to defend, indemnify, and hold harmless atxatx and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your transactions or interactions with other users, or your violation of these Terms or another person’s rights, to the extent permitted by law.

Governing law. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute not subject to another required forum will be brought in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction, except where applicable law provides otherwise.

Changes. We may update these Terms from time to time. We will revise the effective date and provide additional notice when required. By continuing to use the Service after updated Terms take effect, you accept them.

Entire agreement. These Terms and any policies they reference are the entire agreement about the Service. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of operating or transferring the Service.
